1. IDENTIFICATION OF RESPONSIBLE FOR THE WEBSITE
1.1. These Terms and Conditions of Use (hereinafter the “Terms and Conditions”) govern the use of the website https://www.slow-soaps.com/ (hereinafter “website”), the management of which is the responsibility of Sociedade Agricola da Chafurda,
SA, headquartered at Avenida Antonio Augusto de Aguiar, 58 – 5 left, 1050-017, Lisbon with NIPC 504412884, telephone number 967567507 and mail slow.soaps@gmail.com (hereinafter “Slow.Soaps”).
1.2. Slow.Soaps, as an entity that sells cosmetic products,
is registered with INFARMED – National Authority of
Medicines and Health Products, IP under the registration number (in the process of being awarded).
2. OBJECT
2.1. These Terms and Conditions are intended for Users who wish to obtain
information about Slow.Soaps and who intend to purchase products from the website's Online Store.
2.2. The website allows anyone to consult the information provided.
about Slow.Soaps, however prior registration on the website is required
(see clause 4) for the purposes of using the Online Store.
2.3. The User, by registering and/or using the website, accepts the Terms and Conditions and declares for all due effects that he has the legal capacity to contract and assume all obligations associated with such contracting.
3. USE OF THE WEBSITE
3.1. Access and navigation on the website are free and do not require registration. However, to make any purchase on the Online Store or to receive advertising or information, you must be registered as a user on the website.
3.2. Accessing and browsing the website implies express and unreserved acceptance of the Terms and Conditions.
3.3. Acceptance and compliance with the Terms and Conditions will be mandatory for any User who accesses, browses or uses the website. If you do not agree with these Terms and Conditions, we ask that you do not use the website.
4. USER CONDITION
4.1. In order to be able to use the Online Store and, in this sense, purchase Slow.Soaps products, it will be necessary to register a User account, being of legal age to do so.
4.2. The User account must be created using the form provided for this purpose, in which you must indicate all the data indicated as mandatory and define your access password.
4.3. By registering a User account, you undertake to:
4.3.1. Provide only true data in all actions related to Slow.Soaps and provide all necessary data indicated as mandatory.
4.3.2. Keep your username and password diligently and assume responsibility for damage that may arise from possible misuse caused by lack of diligence.
4.3.3. Do not engage in unlawful activities or activities contrary to good faith and public order, or use the website for any of these purposes.
4.3.4. Do not cause damage to the physical and logical systems of Slow.Soats, its suppliers, third parties or introduce or spread a virus on the computer network or any other physical or logical system capable of causing the aforementioned damage.
4.3.5. Do not attempt to access third-party User accounts, or change their messages.
5. PRODUCT PURCHASE PROCEDURE
5.1. As mentioned above, in order to make a purchase at the Store
Online you must be a registered User on the website - referred to therein
as a Member.
5.2. As a registered User, if you wish to purchase one of the various products available on the Online Store, you must press the button designated for this purpose and add the desired product to your cart and then fill in the requested form.
5.3. The User must confirm the order of the products added to his cart by pressing the button referring to Order and pay.
5.4. The User completes his purchase by proceeding to the payment stage.
Any confirmed order implies, in particular, acceptance of the price corresponding to the Product(s) purchased. The order will only be final when the corresponding price has been paid. The User guarantees that he has full right to use the payment methods he uses.
5.5. Upon completion of the order, the User will receive an email (at the email address registered with the User account) confirming the details of the order, namely the amounts invoiced, the quantities and the description
of the purchased products. All documents mentioned above may be
printed and will constitute the contract in a durable format. The User accepts that the computer records of the order are proof of said order and its date.
5.6. The User may, at any time, check the status of his order by clicking on the "My Account" link or print his order from the confirmation email received.
5.7. In case the ordered products are not available after confirmation of the order by Slow.Soaps, the User will be informed by Slow.Soaps by email of the total or partial cancellation (as applicable) of their order.
In this case, the User may place a new order.
5.8. Any abnormal or bad faith order, any fraud or attempted fraud, any incident relating to the payment of the price may result in the deletion and/or deactivation of the account of the customer involved and/or the refusal of the
order.
6. PRICES
6.1. The prices and offers presented are valid exclusively for orders placed on the Online Store and only for the time it is consulted, as they may change. The price that will be charged for the purchase will be that
which corresponds to the product(s) purchased at the time of formalizing the order, under the terms indicated in the previous clause.
6.2. The value of the delivery costs is automatically calculated according to each order, and this value appears in the User's order summary, before the order confirmation (see clause 5.2). Thus, when purchasing the Product, the User knows exactly the total price in Euros (€),
including any applicable fees and taxes, as well as shipping, delivery, postage or other charges. Furthermore, once the order is confirmed, the price is confirmed in the confirmation email sent to the User.
6.3. If any additional transport, delivery and postal charges are due, the User will be informed of them prior to the time of order confirmation.
7. SHIPPING COSTS
7.1. Shipping and/or handling costs, which are not included in the price, will be shown before finalizing the purchase, as they may vary depending on the shipping address and the weight of the order.
7.2. No amount will be charged for handling and delivery costs when the order exceeds the minimum value advertised in each case on the website.
8. PAYMENT METHODS
8.1. Payment on the website can be made via Mbway, Paypal and Manual, in this case, as agreed. THE
use of these payment methods does not entail any additional cost.
8.2. The User guarantees that he/she has the necessary authorizations to use the chosen payment method.
9. SHIPPING AND DELIVERY TIMES
9.1. Orders placed on the Online Store can be sent anywhere in the national territory (including the autonomous region of the Azores and Madeira) but, under no circumstances, to the PO Boxes.
9.2. The delivery of the purchased products will be carried out within 7 working days, counting from the moment of confirmation of the order (see clause 6.6).
9.3. If an order is returned by the transport company to the merchant due to the User's fault (such as an error in the shipping address or negligence in receiving), the order will not be sent again until a new delivery order is paid. To indicate the procedure, you must contact the merchant
which you purchased the product(s).
10. RETURNS AND FREE RESOLUTION RIGHT
10.1. If, upon delivery, the user finds that the packaging is damaged, he must indicate in writing in the delivery note of the transport company and contact Slow.Soaps, within twenty-four hours, through
from slow.soaps@gmail.com . Return charges will be borne by Slow.Soaps.
10.2. All customers may exercise their right of free termination, within a maximum period of fourteen (14) days from the moment the User or a third party, with the exception of the carrier, indicated by the consumer, acquires the
physical possession of the goods, in the case of purchase and sale contracts, or:
i. The day on which the User or a third party, with the exception of the carrier, indicated by the User acquires physical possession of the last good, in the case of several goods ordered by the consumer in a single order and delivered separately;
ii. On the day on which the User or a third party, with the exception of the carrier, indicated by the User acquires physical possession of the last batch or item, in the case of delivery of a good consisting of several batches or items;
iii. From the day on which the User or a third party appointed by him, other than the carrier, acquires physical possession of the first good, in the case of contracts for the periodic delivery of goods during a certain period.
10.3. If the User exercises his right of free termination, Slow.Soaps will refund all payments received, including delivery costs - with the exception of additional expenses resulting from the User's choice of a method
of different delivery and with a higher value in relation to the cheaper option that is offered - without any delay or impediment and, in any situation, within a maximum period of 14 days from the date on which the supplier of the good or service
was informed of the decision to terminate the contract, or in any of the cases applied in the legislation in force, applicable to Users. In any case, the return will be made through the same means used by the customer to make the initial payment, unless the customer chooses a different means,
which may incur additional costs.
10.4. If the goods, by their nature, cannot normally be returned by regular mail, it will be the User's responsibility to bear the costs of returning them.
10.5. In accordance with the applicable legislation and taking into account the products sold on the Online Store, it will not be possible to exercise the right of free withdrawal after delivery if:
i. The supply of goods was made in accordance with the specifications required by the User, or customized.
ii. The supply includes products that may deteriorate or expire within a short period of time.
iii. The supply includes sealed goods which are not suitable for return due to health or hygiene protection reasons and which have been opened after delivery.
iv. The supply of goods, which after delivery and taking into account their nature, have been indissolubly mixed with other goods.
v. The provision of sealed sound or video recordings or sealed computer programs that have been tampered with by the consumer and user after delivery.
saw. The supply of daily press, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.
vii. The provision of digital content that is not provided in a material medium, when the execution has started, with the prior express consent of the consumer and user that they have lost their right to return as a result.
10.6. Slow.Soaps will make available via e-mail with the customer's request the form for exercising the right of free termination, the use of which by the consumer is optional. If you make use of this option, we will send you without delay, on a durable medium, a notice of receipt of the request for resolution.
10.7. Without prejudice to the cases provided for in the applicable legislation, it will not be possible to return products purchased through the Online Store.
11. WARRANTIES
11.1. Slow.Soaps guarantees that all products offered are original products of the brand, with a guarantee from the manufacturer and without any defects, with the legally recognized guarantee terms and which will be those of the nature of the product and, if applicable, with after-sales service in accordance with the
regulations applicable to Users, as consumers.
11.2. To complain and enforce the guarantee, the customer can contact Slow.Soaps
within a general period of two (2) years, from the delivery of the good and always taking into account
the conditions and limitations provided for in the applicable legislation.
11.3. Slow.Soaps is not responsible for damages and/or losses that may be caused to Users as a result of non-compliance with this clause and
regulatory conditions applied to consumers and users on this subject.
12. WEBSITE USAGE RULES
12.1. It is not allowed and, due to this, the consequences will be of the exclusive
responsibility of the User, access or use of the website for illegal or unauthorized purposes, more specifically, the following is prohibited, with an enunciative but non-limiting character, as follows:
i. The use of the website in any way that may cause damage, interruptions, inefficiencies or defects in the functionality or computer of third parties.
ii. The use of the website for the transmission, installation or publication of any virus, malicious code or other harmful programs or files.
iii. The use of the website to collect personal data from Users.
iv. Registering on the website with a false identity, on behalf of a third party or using a false profile.
v. Access, without authorization, to any section of the website, to other systems or connected networks or to services offered through the website, through hacking, forgery, password extraction or any other illegitimate means.
saw. Violating or trying to exceed the security or authentication measures of the website or any connected network, or the security and protection measures inherent to the contents offered on the website.
vii. Take any action that causes a disproportionate, unjustified and unnecessary saturation in the website's infrastructure or in the website's network systems, as well as in the online store network systems; or prevent the
normal development of an event, contest, promotion or any
other activity available through the website or any of its functionalities, either by altering or trying to alter, illegally or otherwise, the access, participation or operation, falsifying the result and/or using fraudulent participation methods, by any procedure, and/or any practice that violates these Terms and Conditions in any way.
viii. Allow transactions that are illegal or which are deemed by credit card brands, or the acquiring bank, which can or have the potential to harm your goodwill or negatively influence you. The following activities are prohibited by credit card brand programs: a
sale or offer of a product that is not in full compliance with all laws applicable to Buyer, Issuing Bank, Merchant, Cardholder or Cards.
12.2. The User who does not respect the conditions indicated in this clause will be liable for any claim for damages that may occur as a result. Even if there is no third party claim, Slow.Soaps reserves the right to prevent access to the website by Users who violate these
conditions.
13. INTELLECTUAL PROPERTY
13.1. The User acknowledges and accepts that all brands, trade names or logos, as well as any other intellectual property rights on the content, products and/or any other elements relating to Slow.Soaps are the exclusive property of Slow.Soaps (hereinafter “Intellectual Property of Slow.Soaps”). Under no circumstances does access to the website imply a waiver, license or total or partial transfer of Slow.Soaps Intellectual Property, except when expressly indicated otherwise. The Terms and Conditions do not grant the User the right to use, alter, exploit, reproduce,
distribution or public communication of Intellectual Property from Slow.Soaps Intellectual Property. Any other use or exploitation of any rights will be subject to prior and express authorization specifically granted for this purpose by Slow.Soaps.
13.2. The website as a whole and multimedia artwork is protected as copyright / copyright by applicable law.
13.3. It is also prohibited to remove, ignore or manipulate Slow.Soaps' copyright/copyright or any other notices, as well as the technical protection devices or any information/protection mechanisms that may contain the contents.
14. RESPONSIBILITY
14.1. The parties undertake to fulfill their illegal and contractual obligations arising under this contract. If one of the parties fails to fulfill any of its obligations or impedes the performance by the other party, the right of the other party to claim compensation for damages caused will be generated, both for damages and consequences for the loss of profits.
14.2. The parties will be responsible for any infringement that may have occurred on purpose, and the other party will be indemnified for any error, fault or
negligence that is not attributable to it, and for any damage arising from such infractions or errors attributable to the other contracting party.
14.3. You acknowledge and accept that Slow.Soaps does not guarantee or is responsible, including, but not limited to, the following:
i. Continuity of website content;
ii. Absence of viruses and/or other harmful components on the website or on the server that hosts it;
iii. The invulnerability of the website and/or the impossibility of violating the adopted security measures;
iv. Bad transmission and/or reception of any data and/or information on the internet;
v. Failure of any reception material or communication lines;
saw. Any dysfunction in the internet network that prevents it from functioning correctly
the website and/or the correct development of the services;
vii. The lack of usefulness or performance of the website;
viii. Damage caused to you or third parties, by anyone who violates the
conditions, rules and instructions that Slow.Soaps establishes on the website or by violating its systems;
ix. Any consequences on the performance of the website services arising from false or incomplete information provided by the customer or user;
14.4. Slow.Soaps is not responsible for any damage caused to the User's software or computer equipment during the use of the website, nor for damages or losses of any kind caused by the merchant or the customer arising from failures or disconnections in the telecommunications networks, what
suspension, cancellation or interruption during the provision of the service.
14.5. Slow.Soaps will use all commercial and technical efforts at its disposal to keep its services available through the website, which is an obligation which, however, does not apply to any lack of availability or performance caused by causes beyond its control from Slow.Soaps, force majeure,
Internet access problems, technological problems.
14.6. In any case, Slow.Soaps reserves the right to suspend, modify, restrict or interrupt, temporarily or permanently, access, navigation, use, hosting and/or download of the content and/or use of website services,
with or without prior notification, for Users who violate any of the provisions detailed in these Terms and Conditions, without the User being able to demand compensation for this cause.
15. CANCEL THE USER/MEMBER ACCOUNT
15.1. Users may, at any time, delete their User/Member account by sending their request by email to slow.soaps@gmail.com .
15.2. Slow.Soaps reserves the right to cancel the User's account. In particular, cancellation can be done if a violation of any of the
contractual obligations contained in these Terms and Conditions or violation of applicable law.
16. CHANGE OF CONDITIONS
Slow.Soaps reserves the right to make changes to the Terms and Conditions at any time. Such changes will be communicated to the customer via email, 20 days before the
entry into force of the new Terms and Conditions. If you do not accept the new terms, you must delete your User account, and your continued use of the website will be considered as acceptance of the new Terms and Conditions.
17. APPLICABLE LAW AND COMPETENT JURISDICTION
17.1. These Terms and Conditions are governed by Portuguese law.
17.2. Any dispute that may arise between the contracting parties regarding the interpretation or execution of these Conditions of Use will be the responsibility of the Lisbon Courts.
17.3. The User may resort to alternative consumer dispute resolution entities listed on the Consumer's Portal at http://www.consumidor.tpt/, where
you can dynamically and up-to-date the identification of the aforementioned entities and the respective contacts, or to the European Online Dispute Resolution Platform, available at http://ec.eurotpa.eu/consumers/odr/s.
17.4. The User may submit a complaint through the electronic complaints book as soon as it becomes available.
